Does Social Security Have to Accept My 100% VA Disability Rating?

This issue was addressed by a Federal Court deciding a Social Security disability case a few years ago. The Court stated the VA rating is to be given “substantial weight” in deciding entitlement to Social Security disability. After all, the purpose of the Social Security and VA disability programs are closely related so that “a disability rating by one of the two agencies is highly relevant to disability determinations of the other agency.”
